She <br /> also did not believe there was any problem with putting a septic tank in <br /> the conservation easement as proposed by the applicant. <br /> Mr. Cotton, Town Geologist, concurred with Mr. Lachenbruch that repairing <br /> the landslide would be tricky but it could be done. He also could not <br /> answer if access off Central would work. <br /> Johnson stated that he could not approve with Lot #3; it did not seem to be a <br /> developable lot. He also did not support the placement of a septic tank in <br /> the conservation easement. Two lots rather than three would mitigate <br /> staff's concerns. Tryon also stated concerns about the conservation <br /> easement and grading in a landslide. Siegel mentioned that three lots <br /> would not work and believed requiring an EIR was just prolonging the <br /> process. Hubbard concurred with Siegel. Casey suggested that more <br /> information was needed on such issues as the landslide, the slope of Lot <br /> #3 and access from Central and she recommending continuing the public <br /> hearing. <br /> MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Tryon <br /> and passed by the following roll call vote to not certify the negative <br /> dedaration of environmental impact for Lands of Malek on Buena Vista. <br /> IOW <br /> AYES: Mayor Hubbard and Councilmembers Johnson, Siegel and Tryon <br /> NOES: None <br /> ABSTAIN: Councilmember Casey <br /> MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Johnson <br /> and passed by the following roll call vote to deny the request for a three lot <br /> subdivision for Lands of Malek on Buena Vista Drive based on three lots <br /> not being safe to develop. <br /> AYES: Mayor Hubbard and Councilmembers Johnson, Siegel and Tryon <br /> NOES: None <br /> ABSTAIN: Councilmember Casey <br /> Casey stated that she did not believe the information before them was <br /> complete. <br /> 6.2 Appeal of Planning Commission's Approval of a Request for a Site <br /> Development Permit for a New Residence and a Swimming Pool, <br /> Lands of Shockley, 27781 Edgerton Road. <br /> S <br /> June 19, 1991 <br /> 7 <br />
