the matter had been appealed by the Council because it was a ridgeline house and if he <br /> wanted to, he could listen to the tapes of the meetings. <br /> Mr. Anthony Lagorio, applicant's attorney, referred to the discussion held by the <br /> Planning Commission on the Ng's request for a site development permit for a new <br /> house. The Planning Director's staff report to the Council included the statement that <br /> the primary consideration in granting this site development permit was the siting, <br /> design and mitigation of the proposed two-story residence on a hilltop. <br /> Mr. Walter Chapman, applicant's designer, stated that he had met three times with staff <br /> and at no time had the ridgeline issue be raised. He was aware of the Town's <br /> ordinances but referred to a different interpretation of the ordinance. He did not <br /> believe this home interfered with the skyline. It was a flat sight; not an exposed <br /> skyline. Mr. Chapman also noted that the lot was surrounded by trees; the home <br /> followed the slope of the hillside and none of the neighbors had spoken against the <br /> project at the Planning Commission. <br /> van Tamelen expressed her concerns about compliance with the Town ordinance <br /> stating that two-story houses will not be built on ridgelines. She further commented <br /> that she had been to this site and believed there was a negative visual impact on many <br /> surrounding properties. Johnson stated that he was confident that the mitigation <br /> measures on the site development permit were adequate. He believed the letter and <br /> the spirit of the law would be in place if the conditions were met. <br /> Mr. Ng, applicant, stated that he was an honorable man and if he got the permit, he <br /> would certainly see to it that the conditions were clearly met. He too agreed that <br /> screening was very important. <br /> Tryon stated that a two-story house on the hilltop was not what the residents wanted to <br /> see. She did not believe the project was low profile and thought the Planning <br /> Commission vote ignored the Town's Ordinances. Tryon commented that the Council <br /> should either follow the ordinances or change them. She also noted that the applicants <br /> were not advised adequately enough ahead of time of the ordinances. Although she <br /> did not know where Mayor Pro Tern Siegel was, Tryon believed the issue should be <br /> addressed at this meeting. <br /> MOTION SECONDED AND FAILED: Moved by Johnson, seconded by Casey and failed <br /> by the following roll call vote to deny the appeal and to uphold the Planning <br /> illw Commission's decision to grant a site development permit. <br /> February 7, 1990 <br /> 7 <br />
