Council discussed the situation before them. van Tamelen <br />kv suggested looking into the possibility of a penalty being imposed <br />and Dronkert stressed that Council should consider the City <br />Manager's second option and concentrate on mitigating the impact <br />of this project on the neighbors and the overall community. Two <br />of the suggestions made for mitigation were 25' trees or <br />permanent screening around the property. <br />Mr. Ray Sinsley, applicant's builder, stated that as far as he <br />could tell the plans did not show where the house should be <br />built. He, therefore, placed the house on the property as he <br />thought appropriate. Mr. Babayan, owner, explained the ten foot <br />change in location of the house and also stated his confusion <br />over the height of the house. He stated that he had not intended <br />to violate the rules of the Town in these matters. <br />MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by van <br />Tamelen and passed unanimously by all members present to direct <br />Site Development Committee to require appropriate measures to <br />mitigate impact on neighbors and from off-site from the change in <br />development. These mitigation measures may include: walls, <br />fences, screens, mature trees and mature shrubbery. All <br />mitigation measures must be installed prior to final inspection <br />and prior to the granting of an occupancy permit for the Lands of <br />Babayan. The Site Development Committee shall address the issue <br />of drainage swale and shaii* require one if it is not already a <br />condition of the property. The owner shall submit a reapplication <br />to the Site Development Committee with 'as built' plans showing <br />the residence and all grading. *may (AMENDED BY COUNCIL 8/20/86) <br />AYES: Mayor Fuhrman and Councilmembers Dronkert, Rydell and <br />van Tamelen <br />NOES: None <br />ABSENT: Councilmember Tryon <br />MOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by <br />Dronkert and passed unanimously by all members present to charge <br />Mr. Babayan a fee of $3,500 for resubmittal to Site Development <br />based on Municipal Code Section 10-2.1318 which states 'In each <br />case in which work for which a permit is required by the <br />provisions of the Site Developent Chapter is started without <br />obtaining such permit, the fee for such permit thereafter granted <br />shall be ten times the normal fee for such permit'. <br />AYES: Mayor Fuhrman and Councilmembers Dronkert, Rydell and <br />van Tamelen <br />NOES: None <br />ABSENT: Councilmember Tryon <br />d) Cable TV <br />The City Manager presented his 7/31/86 staff report which <br />included the questionnaire prepared by the ad hoc committee on <br />cable TV and a process for awarding a cable TV franchise <br />agreement. <br />U <br />
