Resolution # accepting an easement for an <br />equestrian and pedestrian pathway on the Lands of Roscoe, 25431 <br />Adobe Lane and ordering recordation thereof <br />The City Engineer explained that the resolution before Council <br />was only for a pathway easement deed. An additional document <br />would be provided for Council at the next meeting. <br />MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by <br />Fuhrman and passed unanimously by all members present to adopt <br />Resolution #128-86 accepting a certain pathway easement deed and <br />to send a copy of Resolution #128-86 to the Pathway Committee. <br />4. Resolution # accepting certain improvements in con- <br />nection with subdivision of Fawn Creek Court (Page Mill Road) <br />Dr. Bavor, 13816 Page Mill Road, noted that his property was sur- <br />rounded on three sides by the proposed development and he had <br />concerns about the following: grading, drainage and <br />privacy/safety. He recommended the following: fill be brought in <br />and drop off leveled, pipe be installed from end of swale to <br />road, and he be allowed to build a 6' opaque fence around his <br />property and have the fees waived for this project. <br />Mr. Bob Foulk, applicant, stated that he had worked with the <br />Bavors on these concerns and they had agreed on ways to address <br />the problems. <br />Dr. Bavor, 13816 Page Mill Road, stated that he was willing to <br />withdraw his protest based on the gentleman's agreement with Mr. <br />Foulk that the problems would be addressed as they had discussed. <br />Dr. Bavor did ask, however, that Council consider his request for <br />a fence. <br />MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by Tryon <br />and passed unanimously by all members present to adopt Resolution <br />#129-86 accepting certain improvements in connection with sub- <br />division of Fawn Creek Court (Page Mill Road) <br />MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by <br />Fuhrman and passed unanimously by all members present to waive <br />all fees for variance or encroachment permit process for Lands of <br />Bavor, 13816 Page Mill Road, for a fence. <br />5. Resolution # accepting certain improvements in <br />connection with the Lands of Calvo subdivision , 26201 Elena Road <br />MOTION SECONDED AND CARRIED: Moved by Tryon, seconded by Fuhrman <br />and passed unanimously by all members present to continue this <br />item to the next meeting for review by the City Attorney. <br />Mr. Fabian Garces, appliant's representative, noted that as there <br />appeared to be a problem with the bond form submitted, he was <br />willing to write a check for $1,100 to the Town so that this mat- <br />-3- <br />
