SPECIAL OIDERS: Public Hearing l.d) Lands of Sokoloff (continued): <br />Norman Sololoff, applicant, addressed the Council and noted that for their <br />information he had distributed a letter dated 2/13/81 stating his reasons why <br />he thought the variance should be granted and to assist in documenting this <br />letter, he had also distributed verbatim minutes of the October 22, 1980 and <br />December 10, 1980 Variance and Permit Commission meetings. Included in these <br />minutes was a transcription of the Laois of Zepp variance request which Dr. <br />Sokoloff had included for comparison. In addition to these docvnents Dr. <br />Sokoloff also read a prepared statement to the Council outlining what steps <br />he had taken, what suggestions he had received from hislandscape architect <br />and what reasons he felt supported the granting of the variance. (These docur <br />merits are on file at Town Hall.) <br />Mrs. Norman Sokoloff, applicant, noted for the Council's information that a <br />six foot fence would provide m wird protection and there was no way to plant <br />an adequate wind screen. Additionally, planting would cause drainage problems. <br />Mr. henry Sumaraga applicant's landscape architect, renirded Council that he <br />had considered all the possibilities for the Sokoloff's property and what was <br />before Council for their consideration was the best solution. <br />Mr. Alan Stewart, 12165 Hilltop Avenue, presented to Council his reasons why <br />this variance should not be granted specifically mentioning his concern for <br />drainage problams. <br />Mrs. Judith CaricoPlanning Cemission Representative, noted the Commission's <br />opinion that other alternativesto granting the variance were possible; namely, <br />planting without the structure (redwood posts); moving the structure within the <br />30' setback or lowering the height of the structure. <br />Cotscilmanbers discussed the six conditions that needed to be met in order to <br />grant a variance. McReynolds noted that there were other alternatives available <br />and he felt that conditions one, two and three had not been met. Perkins stated <br />that these was a wind problem and the use of the property was strongly affected <br />by this problem. <br />myrION SECONDED AM CARRIED: Moved by Nystrom, seconded by MCReymlds and passed <br />by the following roll call vote to uphold the Variance and Permit Conudssion's <br />denial of the variance request, Lands of Sokoloff, File VAR #11-80, on the basis <br />that conditions one, two and three of the requirauents to grant a variance had <br />not been met (Los Altos Hills Municipal Code, Section 9-5.1107) <br />AYES: Mayor Nystr , Councilmembers Hillestad, McReynolds and Proft <br />NOES: Councilman Perkins <br />-4- <br />
