CITY COUNCIL MINUTES - January 3, 1979 <br />E. SPECIAL ORDERS: <br />1. Public Hearings: <br />a) Request for Tentative Map Approval, LANDS OF BAHR, File <br />TM #2079-78, 2 Lots. <br />After the Public Hearing was opened, the City Engineer advised of the <br />Environmental checklist that had been prepared by Staff. <br />MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by <br />Councilman Nystrom and carried unanimously by all present to adopt a <br />Negative Declaration, LANDS OF BAHR, File TM #2079-78. <br />Mr. Nowack, Applicant's Engineer, requested the deletion of Condition 3C <br />due to the extreme expense caused by the undergrounding of utilities. <br />Councilmembers discussed with the City Engineer the requirement being <br />imposed on the subdivider to underground utilities along South Fork Lane, <br />past experience with deferring major improvements when the land is further <br />subdividable, legal problems with enforcing contingency agreements and the <br />private versus public road issue necessitating the condition. <br />MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by <br />Councilman Perkins and passed by the following roll call vote to delete a� 4 <br />Condition 3C because ordinance 232, Section 9-4.1105 allows existing(` <br />poles on a public right-of-way to remain, therefore, the private road���� <br />of Three Forks Lane shall be considered equivalent to a public road. <br />AYES:- Mayor Pro Tem McReynolds, Councilmembers Nystrom and Perkins. <br />NOES: Councilman Proft. <br />ABSENT: Mayor Hillestad <br />Discussion followed on the proposed ingress/egress to the subject property, <br />centering on the following: (1) Studies made and inadequacies found with <br />regard to Three Forks Lane serving the subdividable property in this area; <br />(2) Enforcement problems the Town will encounter with an open-ended agree- <br />ment for future road improvements; (3) The need for a specific traffic <br />and circulation plan line for this area adjacent to Page Mill Road; and, <br />(4) Alternative routes of access through Lands of Crist, Lands of Cottrell <br />or Lands of Country Way, and the need for more information before a <br />suitable determination might be made. <br />Mr. Nowack, Applicant's Engineer, advised of the costs of the alternative <br />routes and suggested the Lands of Crist as the most viable. <br />Mr. Bahr, Applicant, agreed with his Engineer's suggestion and advised of <br />excessive tree cutting involved in accessing his property through Lands of <br />Country Way. <br />Various solutions were then explored and Council consensus was that this <br />matter had to be resolved now as it had been carried over too many times <br />in the past. V <br />MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by 5 <br />Counci man Nystrom an carried by the following roll call vote to send <br />LANDS OF BAHR back to Staff for clarification of Condition 1D and Q <br />development of alternative traffic circulation plan lines considering <br />all properties involved and to recommend precise implementation measures. <br />It was further directed to continue this Item for thirty days to the <br />% February 7, 1979 meeting for this purpose. <br />AYES: Mayor Pro Tem McReynolds, Councilmembers Perkins and Proft. <br />NOES: Councilman Nystrom. <br />ABSENT: Mayor Hillestad <br />-2- <br />
