VIGNALATS: <br />MOTION, SECONDED AND CARRIED: Councilman Davey moved, seconded by Grabowski and <br />carried unanimously to deny the appeal of Robert Vignalats for relief from the path <br />requirements of the Check Ist for BSA -62-71. <br />SCHEDULED ITEM NO. 7: <br />TOWN'S SEWE—R-P-001TY7. DISCUSSION AND ACTION. <br />Staff reviewed that this was a continuation of the May Ist meeting and noted numerous <br />correspondence had been received as well as a post card survey circulated by the Los <br />Altos Hills Association. <br />MOTION, SECONDED AND CARRIED: Councilman Grabowski moved, seconded by Helgesson <br />and carried by majority vote that all letters received be read Into the record. <br />All letters supported the current Town policy on sewers and/or zonl ng and were <br />from: Mmes. Cathy Ward and Anne Spencer, Shirley Smith, Judy Carico, Lynn and Martha <br />Hunton, Marjorie Colligan, R. Saunders and Carol Spencer; Messrs. Kenneth Carter, <br />Wm. Ross Aiken, Francis Motzenbecker Jr., Donald Clarke and Burt Bedford. In addi- <br />tion a petition supporting Resolution No. 458 was circulated and signed by Annabel <br />Bolssevain and bore signatures of Mr. and Mrs. Paul Sturm, Gene Smith, Howard Nelson, <br />Jan Bolssevain, Mrs. Florence Fava and Mr. Herbert Ginsberg. <br />The City Clerk reported the following results from postcards dated May II, 1972 and <br />malted to Town Hall: <br />YES NO <br />kar Do you favor present sewer policy (Res. No. 458)1 525 44 <br />Do you favor retaining minimum single-family <br />residence per acre? 573 5 <br />Floor participants speaking in favor of present policies were: Dr. Northcutt; Messrs. <br />L. Brubaker, Wm. Downey, B. Kirkpatrick and A. Laws; Mmes. H. Schick, B. Hyde and <br />F. Fava. <br />Speaking against the Town's Sewer Policy were Messrs. D. Jansson, H. Clay, G. Ferrari <br />and M. Katz. <br />Mayor Helgesson, having heard comments from all floor participants, closed the public <br />hearing. Councilman Kubby responded to criticism and allegations made by members of <br />the audience and in communications read. He referred to the confidential letter from <br />Mr. J. Lynch which had been read at the last meeting and reiterated that he wanted <br />the citizens to realize all of the factors considered by him as a councilman In arri- <br />ving at his decision. Recognizing the attorney's correspondence was privileged, he <br />stated, that privilege was declined because of an overriding purpose. He noted that <br />except for his residence, he did not own any undeveloped acreage within the Town, <br />neither Is he pushing for low cost subsidized housing In the Town, and neither is he <br />In need of a sewer, since he is already serviced by Sewer Assessment District No. 3. <br />He emphasized therefore that he had "no axe to grind" concerning the Town Sewer Policy <br />other than his desire as a citizen and councilman to see that the Town adheres to the <br />ordinary State Laws in the formation of sewer assessment districts as opposed to the <br />current "undemocratic and un-American policy that allows the minority to disenfran- <br />chise the majority".
