E( UNSCHEDULED ITEM NO. 1: <br />1�r HOLM, KLAUS (V-329-69) - Request for 15' reduction in rear and side setbacks <br />to 15' fox pool at 12440 Hilltop Drive. <br />Staff report was presented noting the applicant had requested a 15' reduction <br />in side and rear setback to 15' but that the Planning Commission recommended <br />the pool be rotated so as to lie parallel to contours and further recommended <br />a 10' reduction in side and rear setbacks, rather than the 15' requested. <br />MOTION AND SECOND: Councilman Benson moved, seconded by Helgesson, that a <br />10' reduction in side and rear setbacks to 20' for pool at 12440 Hilltop <br />Drive be approved. <br />Council discussion ensued, with Floor participation by Mrs. Holm and Mrs. <br />Louise Dronkert, 11985 Magdalena Road, speaking in support of the variance. <br />Mrs. Holm noted the following: Nineteen neighboring property owners had <br />signed approval of the 15' variance request; relocating the pool would move <br />it closer to the slope and would place a portion of the pool under existing <br />trees, as well as restrict the amount of decking possible; the applicants' <br />intend to fence the entire property. <br />MOTION AMENDMENT AND VOTE: Councilman Benson moved, seconded by Helgesson, <br />that the Motion approving the variance of Klaus Holm (V-329-69) be amended <br />to allow a 15' reduction in side and rear setbacks. The amended motion <br />granting the variance was carried unanimously by voice vote. <br />SCHEDULED ITEM NO. 1: <br />PUBLIC HEARING RE: AMENDMENTS TO ZONLIG ORDINANCE NO. 78, CONCERNING <br />VARIANCE CRITERIA AND BUILDING SETBACK LINES. <br />Staff report was presented noting the Planning Commission had conducted a <br />Public Hearing and recommended changes to the Zoning Ordinance which would <br />clarify definitions of certain area setback building lines and criteria for <br />granting of variances. <br />City Manager noted that present ordinance requirements called for a 40' set- <br />back from all street rights-of-way and that a change is proposed to provide <br />one 30' setback and one 40' setback when property is bounded by more than <br />one street. <br />At 8:14 P. M., Mayor Aiken declared the Public Hearing open and there being <br />no comment from the Floor, declared the Public Hearing closed at 8:15 P. M. <br />Council concurred to consider action later in the Agenda under ORDINANCES. <br />SCHEDULED ITEM NO. 2: <br />CONSIDERATION OF CONTRACT WITH COUNTY SHERIFF'S OFFICE. <br />Mayor Aiken stated Staff had requested additional time to review the <br />contract with the Santa Clara County Sheriff's Office. <br />Council concurred this matter should be continued. <br />UNSCHEDULED ITEM NO. 2: <br />BOBB,HOWARD S. (358-69) Tentative Map, 2 lots, 3.54 acres, Black Mountain Rd. <br />Engr. J. S. Riley. <br />Staff report was presented noting this matter had been continued to allow <br />clarification of pathway requirements and that the Pathway Committee <br />recommended in -lieu path payment for Black Mountain Road frontage. City <br />Manager noted additional conditions on the Check List included clarification <br />-2- <br />
