He explained that the J & R Co. has objected to approval of the variance , but that the Planning Commission has re- commended approval. ACTION: That the request of Barbara B. Peterson (136-63) be approved. MOTION: Henley; SECOND: Bowler; Mr. M. R. Johnson of the J & R Co. commented, stating his objections, and subsequently, at the request Of the Clerk, withdrew his objections. VOTE: Passed unanimously D-VISIONS OF LAND: 1. Albertsworth, E. A. (245-63) 7 lots. Engr. Charles Coburn. The Map was withdrawn at the request of the Subdivider. 2. 1:Lg1er, Fred (248-63) 12 lots. Engr. John W. Riley. The Clerk read the provisions of the Check List and recommendation for approval from the Planning Commission and all agencies. The Mayor called attention to the existing bridle path along the Vogler property and adjoining lands of Ferris and suggested that an easement be granted in order that the path may not have to be abandon- ed. Mr. Vogler stated that he would be agreeable to granting the easement. Following discussion, relating to drainage within the subdivision, the decision was to have the Staff take care of the matter, working out a solution with Mr. Vogler. Councilman Fowle called attention to the two (2) driveways on Natoma Roads (Lots 8 and 11) . The Clerk explained that these driveways cannot be closer than one hundred feet (100 ' ) to the intersection. ACTION: That the Tentative Map of Fred Vogler (248-63) lots be approved subject to the conditions of the Check List, the City Engineer' s letter, and acceptance of the in lieu payment for paths if re- quested by the Subdivider, and grant of an eight foot (8' ) mini- mum public easement between Black Mountain Road and the Ferris property by any route acceptable by the City Manager and the subdivider. ` MOTION: Fe- 1,j: SECOND: Henley; VOTE: Passed unanimously
